Coroner's Finding: Kirk, Rodney

Rodney Kirk, aged 73, died of aspiration pneumonia following advanced dementia at the Roy Fagan Centre in February 2021. He had been cared for in this specialist facility since October 2019 due to behavioural symptoms too challenging for residential aged care. His wife held a guardianship order with powers of restraint under the Guardianship and Administration Act. The coroner found he received good care and treatment at the facility. The key clinical lesson is the management of aspiration risk in advanced dementia patients with severe language impairment. The coroner determined no mandatory inquest was required as Kirk did not meet the statutory definition of 'person held in care' under the Mental Health Act—dementia is explicitly excluded from the definition of mental illness in that Act. No recommendations for systemic improvement were made.
